Terms of Service

1. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

2. The Service

ProspectProps provides real estate prospecting tools, including property and owner data search, lead scoring, and built-in outreach (calling, texting, and email), some of which are powered by artificial intelligence. Features, data sources, and limits may change over time. We do not guarantee the accuracy or completeness of any third-party data surfaced through the Service.

3. Acceptable Use & Outreach Compliance

You are solely responsible for how you use the Service to contact consumers. You agree to comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, federal and state Do-Not-Call (DNC) rules, CAN-SPAM, and any recording-consent laws in the jurisdictions you operate in.

You represent that you have a lawful basis and any required consent to contact the individuals you reach through the Service. You will not use the Service for unlawful, harassing, deceptive, or abusive communications. While we provide DNC-checking tools, you remain responsible for verifying that your outreach is compliant.

4. Subscriptions, Billing & Usage Limits

Paid features are offered on a subscription basis for Property Search and/or Call Campaigns, billed monthly or annually through our payment processor, Stripe. By subscribing, you authorize us to charge the applicable fees, including any overage charges for usage above your plan’s included limits (e.g., additional reports or call minutes) at the rates shown at checkout.

Subscriptions renew automatically until cancelled. You can manage or cancel your subscription at any time from the billing portal in your account settings. Except where required by law, fees are non-refundable, and cancelling stops future renewals rather than refunding the current period.

5. Intellectual Property

The Service, including its software, design, and content (excluding your data), is owned by ProspectProps and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You retain ownership of the data you upload or generate.

6. Third-Party Services

The Service integrates with third parties (for example, Stripe for payments and providers of property, owner, and telecommunications data). Your use of those services may be subject to their own terms, and we are not responsible for third-party products or content.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will be accurate. Nothing in the Service constitutes legal, financial, or real estate advice.

8. Limitation of Liability

To the maximum extent permitted by law, ProspectProps and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold ProspectProps harmless from any claims, damages, or expenses arising out of your use of the Service, your content, or your violation of these Terms or any law, including any communications you send through the Service.

10. Termination

We may suspend or terminate your access if you violate these Terms or use the Service in a way that could cause harm or legal exposure. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by email. Your continued use after changes take effect constitutes acceptance of the revised Terms.
